SMS / Messaging Terms

1. Overview

These Messaging Terms govern transactional SMS/text messages sent through the OptiPay360 platform ("OptiPay360," operated by Optimum Payment Solutions). They apply to Merchants who use the Platform's messaging features and to the End Customers who receive messages.

2. Program Description

OptiPay360 enables Merchants to send transactional text messages to their customers, including:

  • Invoice notifications and payment links
  • Payment reminders
  • Estimate notifications
  • Payment receipts
  • Appointment confirmations and reminders

Messages relate solely to the recipient's own transactions, invoices, estimates, or appointments with the Merchant. We do not send marketing or promotional content through this program.

3. Consent (Opt-In)

End Customers provide their mobile number and consent to receive transactional messages at the point of service — when they transact with or provide their contact information to the Merchant. The Merchant captures and attests to this consent within the Platform. Consent to receive messages is not a condition of purchase.

Merchants are responsible for obtaining and maintaining valid consent from each recipient in compliance with the Telephone Consumer Protection Act (TCPA) and applicable law, and for the accuracy of recipient phone numbers.

4. Message Frequency

Message frequency varies and depends on the recipient's transactions and interactions with the Merchant (for example, when an invoice is sent, a payment is made, or an appointment is scheduled). Recurring scheduled messaging is not the basis of this program.

5. Message & Data Rates

Message and data rates may apply, depending on the recipient's mobile carrier and plan. The recipient is responsible for any such charges.

6. Opt-Out (STOP)

Recipients may opt out at any time by replying STOP to any message. Upon opting out, the recipient will receive a confirmation message and will no longer receive transactional SMS through the program (other transactional channels such as email may still apply).

7. Help (HELP)

Recipients may reply HELP at any time to receive information about the messaging program and how to get assistance.

8. Privacy

Mobile phone numbers and messaging consent are processed in accordance with our Privacy Policy. Mobile information is not shared with or sold to third parties for their marketing or promotional purposes. Numbers and consent data are used solely to deliver the transactional messages described here.

9. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier and network conditions outside our control.

10. Changes

We may update these Messaging Terms from time to time. Material changes will be indicated by updating the "Last Updated" date. Continued use of the messaging features constitutes acceptance.
